1. Nature of the Platform
HALLUBER is a digital technology platform that connects passengers with independent drivers. HALLUBER does not provide transportation services, employ drivers, own vehicles, or operate as a transport company. Drivers are independent contractors. HALLUBER acts solely as a technology intermediary. This clause protects HALLUBER from transport liability under Moroccan law (Law 09-08, Law 31-08, Law 53-05).
2. Acceptance of Terms
By using HALLUBER, users agree to these Terms, Moroccan law, and platform policies. This forms a legally binding agreement.
3. Independent Contractor Status of Drivers
Drivers using HALLUBER are independent contractors. Drivers are solely responsible for driver license validity, vehicle condition, insurance, legal compliance, and passenger safety. Drivers are NOT employees of HALLUBER. This protects HALLUBER from labor lawsuits.
4. Platform Function
HALLUBER provides driver-passenger connection technology, trip request system, fare agreement system, and safety monitoring tools. HALLUBER does not guarantee driver availability.
5. Cash Payment System (Launch Phase)
At launch, all rides are paid in cash. Passengers pay drivers directly. HALLUBER does not handle, store, or collect cash. Drivers are responsible for collecting cash. HALLUBER is not liable for cash disputes, cash theft, or cash loss. This protects HALLUBER from financial liability.
6. Platform Service Fees
Drivers agree that HALLUBER may charge platform service fees. Drivers remain responsible for paying platform fees to HALLUBER. Failure may result in suspension.
7. User Conduct
Users must not commit fraud, provide false information, harass drivers, or harass passengers. Violation may result in permanent suspension.
8. Limitation of Liability
To the fullest extent permitted by Moroccan law, HALLUBER is not liable for accidents, injuries, death, vehicle damage, driver conduct, passenger conduct, loss of income, or loss of property. HALLUBER provides platform “as is”.
9. Assumption of Risk
Users acknowledge transportation carries inherent risks. Users accept these risks voluntarily.
10. Account Suspension
HALLUBER may suspend accounts for fraud, abuse, safety violations, or legal violations without prior notice.
11. Force Majeure
HALLUBER is not liable for natural disasters, internet failures, or government actions.
12. Governing Law
This Agreement is governed by Moroccan law. Jurisdiction: Tangier courts.

HALLUBER – DRIVER AGREEMENT

Independent Contractor Status
Drivers are independent contractors, NOT employees, agents, partners, or representatives of HALLUBER. Drivers are fully responsible for their own taxes, insurance, and expenses. This protects HALLUBER under Moroccan labor law.
Driver Responsibilities
Drivers are solely responsible for maintaining a valid driver license, valid vehicle registration, valid insurance, vehicle safety, complying with Moroccan transport laws, and ensuring passenger safety. HALLUBER is not responsible for driver actions.
Cash Payment System (Launch Phase)
At launch, all rides are paid in cash. Passengers pay drivers directly. HALLUBER does not collect, store, or process cash. Drivers are solely responsible for collecting cash, managing cash, and handling disputes. HALLUBER is not liable for cash disputes, cash theft, or cash loss.
Platform Service Fees
Drivers agree that HALLUBER may charge platform service fees. Failure to pay may result in account suspension or termination.
Driver Control and Flexibility
Drivers have full control over working hours, ride acceptance, and ride rejection. HALLUBER does not control driver schedules. This confirms independent contractor status.
Limitation of Liability
To the fullest extent permitted by Moroccan law, HALLUBER is not liable for accidents, injuries, death, vehicle damage, passenger disputes, driver income loss, or legal claims arising from transport services. HALLUBER provides platform access only.
Insurance Responsibility
Drivers are solely responsible for maintaining valid vehicle insurance. HALLUBER does not provide insurance coverage. Drivers assume full liability.
Compliance with Moroccan Law
Drivers agree to comply with Law 31-08 (Consumer Protection), Law 09-08 (Data Protection), Law 53-05 (Electronic Transactions), and all Moroccan transport regulations.
Account Suspension or Termination
HALLUBER may suspend or terminate driver accounts for fraud, illegal activity, safety violations, failure to pay platform fees, or violation of platform policies without prior notice.
Indemnification
Drivers agree to indemnify and hold harmless HALLUBER from lawsuits, claims, damages, and legal costs resulting from driver actions. This protects HALLUBER from lawsuits.

HALLUBER – PASSENGER AGREEMENT

Purpose of This Agreement
HALLUBER is a digital technology platform that connects passengers with independent drivers. HALLUBER does not provide transportation services. Transportation services are provided exclusively by independent drivers.
Acceptance of Terms
By accessing or using HALLUBER, the user agrees to this Passenger Agreement, Moroccan law, and platform policies. If the user does not agree, they must not use the platform.
Nature of the Service
HALLUBER provides technology connecting users and drivers, ride request functionality, driver matching services, and safety monitoring tools. HALLUBER does NOT provide transport services, employ drivers, own vehicles, or control driver behavior. Drivers are independent contractors.
Cash Payment Policy (Launch Phase)
At launch, all rides are paid in cash. The user agrees to pay the driver directly in cash. HALLUBER does not collect, process, or handle cash. HALLUBER is not responsible for cash disputes, cash theft, cash loss, or payment disagreements.
User Responsibilities
Users agree to provide accurate information, behave respectfully, not damage vehicles, not threaten drivers, and not commit illegal activity.
Driver Independence
Users acknowledge that drivers are independent contractors, not employees of HALLUBER. HALLUBER is not responsible for driver actions, behavior, or conduct.
Limitation of Liability
To the maximum extent permitted by Moroccan law, HALLUBER is not liable for accidents, injuries, death, driver conduct, vehicle condition, delays, loss of property, or financial losses. Transport services are provided by independent drivers.
Assumption of Risk
Users acknowledge transportation involves inherent risks and voluntarily accept these risks. HALLUBER is not liable for transport-related incidents.
Account Security
Users are responsible for account security and password protection. HALLUBER is not liable for unauthorized account use.
Account Suspension
HALLUBER may suspend or terminate accounts for fraud, abuse, illegal activity, or violation of policies without prior notice.
Indemnification
Users agree to indemnify and hold harmless HALLUBER from legal claims, lawsuits, and damages resulting from user conduct.

HALLUBER – CASH PAYMENT POLICY

Launch Phase: Cash Only
During the initial launch phase of the HALLUBER platform in Morocco, all rides are strictly cash-only.
Direct Payment
Passengers are required to pay the agreed fare directly to the driver in cash at the end of each trip.
Role of HALLUBER
HALLUBER does not handle, process, store, or collect any cash payments. The platform facilitates the connection and fare agreement but does not act as a payment processor.
Liability
HALLUBER is not a party to the cash transaction between the passenger and the driver. Consequently, HALLUBER is not liable for any disputes, theft, loss, or other issues arising from cash payments. Any disagreement regarding payment is solely a matter between the passenger and the driver.
